Terms of Service and Subscription Sales

The document defines the rules for a Customer account, purchasing Estate Office CRM, Trial, subscriptions, payments, renewals, and license handling.

The offer is intended for B2B clients. Before proceeding to payment, the Client accepts these Terms and the plugin license / EULA.

Service provider and contact details

  • The sales website is available at https://estateofficecrm.pl/ and operates under the name CRM System for WordPress for Real Estate Agencies.

Nature of the service and B2B model

  • Estate Office CRM is offered as a tool for the real estate market, intended for business owners and individuals acting on behalf of companies.
  • By placing an order, the client confirms that they are purchasing the product for business or professional purposes. If, in a specific case, mandatory law grants the client the status of a consumer or an entrepreneur with consumer rights, the provisions of the Terms and Conditions do not limit those rights.
  • These Terms and Conditions set out the rules for using the client account, purchasing a license, trial, one-time payments, subscriptions, automatic renewals, and using the licensing system.

Definitions

  • Client: the entity that creates an account, orders a Trial, purchases licenses, or uses the Client Panel.
  • Client Panel: the part of the service where the Client can view licenses, activation domains, payment history, account details, and saved payment methods.
  • License: the right to use the Estate Office CRM plugin in accordance with the selected package, validity period, and EULA.
  • Package: an offer variant that defines, in particular, the price, term, payment type, renewal, access to updates, and domain limit.

Scope of electronic services

  • The Service Provider provides the following services electronically: client account management, registration and login forms, order processing, payments, licenses, domain activation, transaction history, and subscription-related notifications.
  • The licensing service includes generating a license key, verifying the license status, handling domain activation, access to updates during the license validity period, and technical communication with the plugin.
  • Feature availability may depend on the selected plan, payment status, license term, domain configuration, and whether the WordPress environment meets the technical requirements.

Client Account

  • A customer account is required to purchase a paid package. The login is the email address.
  • During registration, the Customer provides the company details, NIP, address, first and last name of the contact person, email address, and optionally a phone number. The account requires acceptance of the privacy policy and email address confirmation, if the confirmation feature is enabled.
  • The client should provide true, current, and complete information and protect the password from access by unauthorized persons.

Trial

  • The trial is free, valid for 30 days from generating the code and does not require a payment card.
  • After the Trial period expires, the license expires unless the Customer logs in to the Customer Panel and selects a paid extension.
  • One email address and one domain can benefit from the 30-day Trial only once for a given product. The Service Provider may refuse to re-Trial if this restriction is circumvented.

Packages, pricing, and promotions

  • Current packages, prices, currencies, subscription periods, promotional information, the lowest price from the last 30 days, and the promotion end date are displayed on the Pricing page before purchase.
  • Current recurring subscription rates: Monthly payment: 27 USD / 1 month (regular price after promotion: 35 USD for the same billing period); Annual payment: 270 USD / 1 year (regular price after promotion: 350 USD for the same billing period).
  • The promotional price applies only during the active promotion period, only to the package where it was shown, and only to a new license.
  • Using the promotional price requires acceptance of the Promotion Terms: https://estateofficecrm.pl/?page_id=210. In eService, lack of acceptance may result in the regular price being charged, and in PayPal an active promotion requires acceptance before proceeding to payment.
  • The Service Provider may change the offer and prices for future periods. The change does not shorten any already paid license period.

Conclusion of the agreement and acceptance of documents

  • Before starting the transaction, the Client must accept the Terms and Conditions and the Plugin License / EULA. Failure to do so will prevent proceeding to payment or generating a Trial.
  • The agreement is concluded upon successful payment or, in the case of a Trial, upon acceptance of the Trial terms and generation of the license code.
  • After purchase, the Customer receives the license code on the thank-you page, in the Customer Panel, and, if email delivery is configured correctly, by email.

Payments and automatic renewals

  • Online payments are processed by independent operators: PayPal (PayPal (Europe) S.à r.l. et Cię, S.C.A.) and PayU (PayU S.A. based in Poznań, KRS 0000274399). The customer selects the operator before confirming the payment. The service provider does not store the full card number or CVV/CVC code.
  • Subscription packages are billed periodically on a monthly or annual basis, according to the variant selected by the Customer before payment begins. The amount due for the given billing period is shown with the package on the Pricing page and in checkout before payment is confirmed.
  • For the current offer, the amount of recurring payments is: Monthly payment: 27 USD / 1 month (regular price after promotion: 35 USD for the same billing period); Annual payment: 270 USD / 1 year (regular price after promotion: 350 USD for the same billing period).
  • If a promotion applies to the package, the first payment or a specified number of the first billing periods may be charged at the promotional price shown before purchase; after the promotion ends, subsequent charges are billed at the regular price indicated for the package and in checkout.
  • For subscription plans, the card or subscription consent is stored with the payment operator as a token. PayPal Subscriptions charges the card automatically according to its own schedule, while in PayU charges are initiated by our plugin using the stored token (MIT payments — Merchant Initiated Transactions).
  • For recurring card payments, full payment card details, including the card number and CVV/CVC code, are stored exclusively by the payment operator selected by the Client: PayU or PayPal. The Service Provider does not have access to the full card data and stores only the technical identifier/token and basic information required to handle the subscription.
  • Automatic subscription renewal is carried out before or on the license expiration date, in accordance with the package and payment system configuration. Failure of payment (e.g., card rejection) may cause the license to become overdue; the payment provider may retry attempts for a period specified in its terms and conditions.
  • The client may cancel automatic renewal at any time in the Client Panel. Cancellation does not end the current period — the license remains active until the end of the paid term, and future charges are suspended.
  • The client may change or remove a saved card or subscription in the Client Panel if the payment operator has returned the method identifier. In the case of PayPal, card changes are made in the client's PayPal account.

Right of withdrawal from the contract (digital content)

  • Estate Office CRM is digital content supplied on a non-tangible medium within the meaning of Article 38(13) of the Polish Consumer Rights Act of May 30, 2014. The license is activated immediately after payment has been credited.
  • Before making payment, the client, who is a consumer or an entrepreneur with consumer rights, expressly confirms by checking the appropriate consent box that they request the service to begin (license generation) before the withdrawal period expires and acknowledge that they lose the right to withdraw from the distance contract.
  • Failure to accept the above consent prevents the online purchase of the license. In such a case, the customer may contact the seller to arrange an individual purchase procedure, while retaining the 14-day right of withdrawal, however without the right to immediate use of the license during that period.
  • Regardless of the above, the Client retains the rights arising from the statutory warranty for defects and the manufacturer’s warranty under the terms set forth in generally applicable laws.
  • In the case of a 30-day Trial, no payment means that the contract ends on the day the Trial code expires - the customer does not submit any declaration of withdrawal because no transaction takes place.

License, domain, and updates

  • Detailed terms of use of the plugin are set out in the Plugin License / EULA: https://estateofficecrm.pl/?page_id=205.
  • The license is assigned to the Client, the product, the package, and the domain limit. The activation domain may be deactivated in the Client Panel if the license status allows it.
  • Access to updates and feature modifications depends on the license status. After the license expires, the plugin may enter limited mode or lose access to updates.

Cancellation, reactivation, and termination of the subscription

  • The client may opt out of recurring payments and cancel future subscription renewals in the Client Panel, in the details of the given license, if such an action is available for that license.
  • If cancellation in the Client Panel is not available or requires assistance, the Client may submit a cancellation of recurring payments by email to support@estateofficecrm.pl, providing the account email address, license key or transaction number, and the package to which the cancellation applies.
  • Cancellation must be submitted before the start of the next billing period or before the scheduled automatic payment charge. Cancellation does not immediately delete the license; the license remains active until the end of the paid period, and subsequent charges are suspended.
  • Renewing a subscription or extending an expired license may require a successful payment and, for a subscription, an active saved payment method.
  • The Service Provider may suspend or block access to the services in the event of non-payment, violation of the Terms and Conditions, violation of the EULA, attempts to bypass license limits, or the delivery of unlawful content.

Technical requirements

  • To use the service, you need a current web browser, enabled essential cookies, internet access, and an active email address.
  • To use the plugin, you need a WordPress installation and a PHP environment compatible with the product requirements and the information published with the plugin.
  • The client is responsible for ensuring that their website, hosting, backups, WordPress configuration, and other plugins comply with technical requirements and the security of their own installation.

Complaints and Support

  • Complaints regarding services, payments, licenses, or system performance may be submitted to: support@estateofficecrm.pl.
  • The complaint should include the Client's details, a description of the issue, the transaction number or license key, if applicable, and the expected resolution method.
  • Complaints regarding a recurring order, including an automatic charge, the amount charged, application of a promotional or standard price, cancellation of renewal, or subscription status, may be submitted to: support@estateofficecrm.pl.
  • A complaint regarding a recurring order should include the Client account email address, package, charge date, payment operator, transaction number or license key, and a description of the request.
  • Complaints regarding recurring orders will be reviewed within 14 calendar days from the date of receipt. A response will be sent to the Client's email address or in another agreed manner.
  • The Service Provider will review other consumer complaints within 14 calendar days from the date of receipt. Failure to respond within this period means the complaint is accepted pursuant to Article 7a of the Consumer Rights Act. In B2B transactions, the Service Provider will respond within a reasonable time, usually up to 30 days, depending on the complexity of the matter and the need to contact the payment operator.
  • Complaints regarding the payment process itself (e.g., declined charge, duplicate payment, incorrect amount charged by the operator) may be submitted separately directly to the payment operator — PayPal or PayU — in accordance with their complaint procedures.

Out-of-court dispute resolution

  • The consumer may use out-of-court complaint handling and claim enforcement procedures, including mediation conducted by the Provincial Inspectorates of the Trade Inspection and permanent consumer arbitration courts.
  • The consumer also has access to the EU online dispute resolution platform (ODR — Online Dispute Resolution) available at https://ec.europa.eu/consumers/odr — the platform serves as a one-stop shop for out-of-court dispute resolution arising from contracts concluded online between consumers and businesses established in the EU.
  • Using the out-of-court procedure is voluntary and requires the consent of both parties to the dispute.

Personal Data and Privacy

  • The principles for processing personal data, payment data, license data, and cookies are described in the Privacy Policy: https://estateofficecrm.pl/?page_id=3.
  • Acceptance of the Terms and Conditions does not constitute marketing consent. Marketing communication by email, SMS, or phone requires separate consent or another legal basis provided for by law.

Liability

  • The Service Provider is responsible for proper performance of the services to the extent set out in the Terms and Conditions, the EULA, and mandatory applicable law.
  • In B2B relations, to the maximum extent permitted by law, the Service Provider's liability for lost profits, website downtime on the Client's side, data lost due to the Client's lack of backups, or conflicts with third-party plugins is excluded.
  • Nothing in the Terms and Conditions excludes liability that cannot be limited under mandatory applicable law.

Terms and Conditions Changes

  • The Terms and Conditions may be changed for important reasons, such as changes in the law, changes in product functionality, a change of payment provider, changes to the package model, or the need to clarify security rules.
  • Changes regarding active subscriptions are communicated to the Client in the Client Panel or by email in advance, if the change affects the Client's rights or obligations.

Final provisions

  • The governing law is Polish law. Matters not regulated herein shall be governed by generally applicable provisions.
  • In B2B relations, disputes will be resolved by the court having jurisdiction over the Service Provider's registered office, unless mandatory provisions of law provide otherwise.
